The paper concentrates on the most pressing question of Indian philosophy: what is the exact connotation of a word or what sort of entity helps us to identify the meaning of a word? The paper focuses on the clash between Realism (Nyāya) and Apoha vāda (Buddhist) regarding the debate whether the meaning of a word is particular/universal or both. The paper asserts that though Naiyāyikas and Mīmāṁsakas challenged against Buddhist Apoha vāda, yet they realized that to establish an opinion in (...) support of a word that conceptually denotes a negative meaning first would be a very difficult task. The contemporary debate centering round the circumference of feminist discourse has of late been very potent in addressing the issues of certain prejudiced notions in our existing patriarchal structure. This paper is an attempt to show the ongoing paradox existing in the world of feminism which has thoroughly critiqued the patriarchal culture and has naturalized sexual identities, thereby glorifying man’s supremacy and dominion. The patriarchal culture lionized the ideals of brevity, courageousness, and intellect and thought of these as the only (...) special possessions of man in society. The qualities of being submissive, kind and caring in nature is considered to be “ideal” and exclusive qualities of a woman. Even though these qualities are “ideal” to women, they are discarded from being considered as universal in nature and are thought of as insignificant in the mainstream societal structure. These qualities are treated as inferior, and exclusively womanly and hence cannot make their stand in the conventional patriarchal social order. For this reason a dilemmatic situation arises here. My effort is to show that this dilemma cannot be exposed in the sense of gender specific human qualities. (shrink)

The present article concentrates on understanding the limits of language from the realm of meaning theory as portrayed by Wittgenstein. In the Tractatus, Wittgenstein’s picture theory provides a glimpse of reality by indicating that a picture could be true or false from the perspective of reality. He talks about an internal limitation of language rather than an external limitation of language. In Wittgenstein’s later works like Philosophical Investigations, the concept of picture theory has faded away, and he deeply becomes more (...) interested in the ‘use theory of meaning’ and ‘language game.’ My other attempt in this paper is to show Husserl’s theory of meaning and try to find out its compatibility with Wittgenstein’s thoughts. Husserl thinks that as a part of phenomenological experience, ‘meaning’ should be an act character that Wittgenstein rejected as an appeal of inner experience. Like Mohanty, I also attempt to show the Husserlian idea of meaning as an essence that is related to the meaning rather than linguistics. Both the giants are talking about description of language from different levels. My effort would be to illustrate how these two giant thinkers proclaim their meaning theories in such a way that leads to a well-known internalism versus externalism debate in the philosophy of mind and language. The paper concentrates on an appreciation of W.V. Quine’s thought on meaning and how it escalates beyond the meaning holism and confirmation holism, thereby paving the way for a ‘meaning nihilism’ and ‘confirmation rejectionism’. My effort would be to see that how could the acceptance of radical naturalism in Quine’s theory of meaning escorts him to the indeterminacy thesis of meaning. There is an interesting shift from epistemology to language as Quine considers that a person who is aware of linguistic (...) trick can be the master of referential language. Another important question is that how could Quine’s radical translation thesis reduce into semantic indeterminacy that is a consequence of his confirmation methord. Even I think that the notion and the analysis of meaning became hopelessly vague in Quine’s later work. I further argue on Quine’s position of meaning that I call, following Hilary Putnam, ‘meaning nihilism’. It seems to me that Quine had no belief like ‘meaning consists in’, or ‘meaning depends on’ something. Through this argument, I would like to challenge the confirmation holism that was foisted by Fodor on Quine’s thesis. My attempt would be to scrutinize Putnam’s point of view that Quine was neither a confirmation holist nor a meaning holist. I think that both Putnam and Quine denied the concept of constitutive connection of meaning as a second grade notion not only from the realm of semantic, but also from the perspective of epistemology. So, linguistic meaning cannot be formed by any sample of its uses. For Quine, the concept of meaning in metaphysics is heuristic and need not be taken seriously in any ‘science worthy’ literature. In recent years, there has been a huge resurrection of interest in the idea of ‘analysis,’ encompassing on analytic philosophy. As with any major philosophical movement, it is futile to define or classify any precision of what makes someone an analytic thinker. However, drawing on the startling works by Frege, Russell, Wittgenstein, Dummett and Putnam I clear up some strands, portended by the observation that language is the sole medium of analytic philosophy, so the main focus of analytic philosophy is (...) to understand the structure of language, thought, and meaning. Analytic philosophy pursues a critical analysis on the interface between word and world interrelation in terms of natural language guided by analysis, reasons, clarity and reflective thoughts. Ein Leitmotiv der medizinethischen Auseinandersetzung mit der tiefen Hirnstimulation (THS) ist die Beschäftigung mit Fragen personaler Identität. Da es sich bei personaler Identität auch um ein Problem der theoretischen Philosophie handelt, wird in diesem Aufsatz nicht nur die praktische Frage nach der ethischen Legitimation der THS durch informierte Einwilligung gestellt und ein modifiziertes Legitimationskriterium für wesensändernde THS erarbeitet. Vielmehr wird zunächst versucht, das Problem, um das es in der Debatte um THS und personaler Identität geht, besser zu verstehen.

In diesem Artikel geht es um die Beziehungen zwischen der von Jürgen Habermas entwickelten Diskursethik und den Studierendenseminaren, die der Ulmer Arbeitskreis „Ethik in der Medizin“ veranstaltet. Zunächst erfolgt eine Darstellung der Kernaussagen der philosophischen Diskursethik. Sie liefert eine formale Argumentationsprozedur, mit der es möglich ist, die Legitimität strittig gewordener Normen im Diskurs zu prüfen. Anschließend wird das in Ulm von Baitsch und Sponholz entwickelte Modell der Seminare „Ethische Entscheidungskonflikte im ärztlichen Alltag“ vorgestellt. Da sich die Ulmer Seminare unter anderem (...) auf die Diskursethik als theoretischen Hintergrund berufen, werden die Gemeinsamkeiten und Unterschiede beider Konzepte untersucht. Der Hauptunterschied ist der zwischen einem Begründungs- und einem Anwendungsdiskurs. Gemeinsam sind den Ansätzen die grundsätzlich kognitivistische Einstellung und die „Spielregeln“ des Diskurses. In Entwicklungsprozessen sahen beide Harmonie und Ordnung gegenstrebiger Vorgänge. Konkrete Wahrnehmung und Experimente sind an Beobachtungen geknüpft, durchaus frei von metaphysischen Überhöhungen (Positivismus). Obwohl sie den zeitgenössischen Fortschrittsoptimismus nicht teilen, sind sie doch unermüdliche Befürworter des Lebens in Mannigfaltigkeit und Singularität.

This paper in an elementary level expresses the inevitable relation between the word and meaning from the prominent Indian philosophical trends by giving stress on Vyakti-śakti-vāda and Jāti-śakti-vāda, the two contender doctrines. The first one puts emphasis on the semantic value of a predicate whereas the latter draws attention to the generic uses of nouns. The second part of the writing underpins Navya Nyāya and Kumārila’s positions on the word-meaning reliance and the debate initiate when we look back to the (...) question whether the word-meaning relation sounds conventional or eternal. I propose a position (śabda-vivarta-vāda) on these issues derived from the works of Patan᷈jali and Bhartṛharị, two grammarians of classical Indian tradition. Este artigo tem por objetivo levantar um debate a respeito da legalização da prática abortiva no Brasil, em razão do Projeto de Lei nº 1.135/91, ainda em trâmite no Congresso Nacional, que pretende a legalização do aborto, até momentos antes do parto. Apresenta-se, de forma introdutória, a problemática do discurso do aborto frente ao Projeto de Lei nº 1.135/91. Para tanto, apresenta-se um discussão sobre a universalidade da vida, o aborto no código penal brasileiro, a questão do avanço do aborto (...) na realidade brasileira, aborto versus Vida, a proibição da pena de morte e a legalização do aborto no Brasil e o Projeto de Lei nº 1.135/91 no Brasil. Conclui-se afirmando que se espera que no Brasil a sociedade reconheça a gravidade da descriminalização do aborto e cobre do Estado seus direitos fundamentais, principalmente o direito a vida. Am 1. Februar 2010 ist das Gendiagnostikgesetz (GenDG) in Kraft getreten. Die Debatte um einige Regelungsbereiche, wie beispielsweise das Neugeborenenscreening, reißt nicht ab. Ein Aspekt des Gesetzes ist im Rahmen der Debatte um die Präimplantationsdiagnostik (PID) in Deutschland unter neuen Vorzeichen zu diskutieren: Das – international bislang einzigartige – Verbot der pränatalen Diagnostik so genannter spätmanifestierender Erkrankungen, die erst nach der Vollendung des 18. Lebensjahres ausbrechen. In diesem Beitrag möchten wir Hinweise zur differenzierten Diskussion dieser in § 15(2) GenDG bestimmten (...) Verbotsnorm liefern. Obgleich Argumente, insbesondere das Recht auf Nichtwissen des geborenen Kindes, für ein solches Verbot sprechen, kommen wir aufgrund der medizinischen Sachlage und nach einer Analyse der Pro- und Kontraargumente aus ethischer und rechtlicher Sicht zu dem Schluss, dass ein generelles Verbot der pränatalen Diagnostik spätmanifestierender Erkrankungen im Sinne der Zielsetzung womöglich insuffizient ist sowie in der Begründung Inkonsistenzen zum bereits bestehenden Regelwerk aufweist, und lenken daher den Blick auf unter Umständen bessere Alternativen. Darshana, in the sense of true philosophical knowledge, Darshana is first quoted in the Vaiśesika Sūtra (first century CE) to mean the perfect vision of everything. Etymologically, Darshana evolves from the Sanskr̥ti term Drś, that is, vision. The contemporary use of the term Darshana finds its new dimension in the writings of Haribhardra (eighteenth century CE), who considers different philosophical schools in the cord of Darshana in his text Ṣad-darśana-samuccaya. Later, eminent Vedāntin Mādhava in fourteenth century CE popularized and expatiated (...) the meaning of Darshana in Sarvadarśana Saṅgraha. The purport of the term Darshana is embedded in the notion of Indianness that caters to an influential uniqueness in Hinduism, Jainism (Samyak Darshana or liberation consists in right vision) and Mahayana Buddhism (Nagarjuna’s dictum tattva-darśana, i.e., the true reality, and Vasubandhu’s use of Darshana marga, i.e., the conduit of seeing). -/- The conception of the word guru in Indian cultures goes back to the Upanishadic era, especially in the Mundakopanishad, where Brahma (the creator of the world) taught the Brahma Vidya (the foundation of all knowledge or the speculative discussion about ultimate reality) to his eldest son, Atharvan. Later, Artharvan transmitted the Brahma Vidya to Angiras, who shared the absolute knowledge with Satyavaha, a successor of Sage Bharadwaja. Satyavaha narrated to Bharadwaja, who finally imparted the knowledge (both the higher and lower levels) to Angiras. One could find a significance herein using the Upanishadic term paraparam (Mundakopanishad, 1.2). The term not only indicates that the foundation of all knowledge has two different folds – para (transcendent) and apar (mundane) – but also that the term paraparam tinges on the transmission progression of the knowledge from guru (enlightened master) to his shisya (dedicated disciple). The proper way of learning Brahma Vidya depends on the gurupasadana; the only guru can condescend to expose wisdom to the devoted disciples. (shrink)

Die Behandlung von einwilligungsunfähigen psychisch kranken Menschen mit neuen Therapiemethoden ist insbesondere im Kontext des „individuellen Heilversuchs“, der als Anwendung wenig erprobter Therapieansätze im Rahmen von „ultima ratio“-Entscheidungen charakterisiert ist, mit ethischen Abwägungsproblemen verbunden. Diese bestehen aufgrund von Einschränkungen in der Handlungs- und Entscheidungsautonomie der betroffenen Patienten und, aufgrund eigen- oder fremdgefährdender Symptome der psychischen Krankheit selbst, insbesondere in der praktischen Umsetzung ethisch akzeptierter Modelle stellvertretender Entscheidung sowie in der Wahl des Bezugspunkts der Nutzen-Risiko-Analyse des intendierten Therapieverfahrens. Der Artikel untersucht (...) den ethischen Konflikt zwischen gerechtfertigter Hilfeleistung und Instrumentalisierungsrisiko psychisch kranker Menschen zu Fremdzwecken am historischen Beispiel der „Rindenexcisionen“ des Psychiaters Gottlieb Burckhardt (1836–1907). Als Lösungsmöglichkeit dieses ethischen Konflikts wird das „Konzept des kontrollierten individuellen Heilversuchs“ diskutiert. (shrink)

The objective of this study is to examine the contemporary approaches to Da'wah methodology in Malaysia. This study undertook an examination of the impact of social media platforms on conversion rates within the context of the Da'wah methodology. The use of a quantitative approach is implemented through the application of a cross-sectional research design. A questionnaire survey was devised to gather data from Islamic scholars residing in Malaysia. Questionnaires were disseminated to Islamic scholars using social media platforms. A total of (...) 155 valid responses were collected to investigate the impact of social media on conversion rates. The study focused on various factors including content type, frequency of exposure, duration of exposure, and follow-up interactions. The findings obtained from the application of Structural Equation Modelling (SEM) indicate that social media platforms play a significant role in increasing the conversion rate of individuals from different religious backgrounds to Islam. The impact of social media on content type, frequency of exposure, duration of exposure, and follow-up interactions is generally perceived as positive, as it tends to enhance the likelihood of conversion rates. This research holds practical significance for Islamic scholars seeking to enhance conversion rates using diverse social media platforms. (shrink)

A pesquisa sobre o dogma mariano mostra que, no seu desenvolvimento, a experiência, mas, sobretudo, a fé vivida, precedeu as proclamações dogmáticas oficiais, de modo que é importante que o dogma mantenha contato com a fé viva da Igreja, pois é nesse contato, que aquilo que está ainda implícito se torne sempre mais explícito sem que haja mudança no seu conteúdo formal, porque não se trata de adição de verdades, e sim de clarificação da verdade. O objetivo desse artigo é realizar uma revisitação, ou seja, uma tentativa de construir um diálogo entre o princípio da sacralidade da vida e o aborto. São apresen-tados quatro motivos para realizar esse diálogo. O primeiro é o fato de constante-mente o cristianismo e especialmente a Igreja Católica ser acusada de ter criado o princípio da sacralidade da vida. O segundo é o fato de que fundações multibilionárias planejam impor o aborto ao mundo até o ano de 2025. O terceiro (...) é que em muitos países o aborto foi legalizado por meio de medida judicial. O quarto é o fato de o Estado possuir uma taxa de nascimentos ideal. Após essa apresentação, são cons-truídas três reflexões sobre o tema. A primeira é que o princípio da sacralidade da vida não é uma construção ou invenção da Igreja Católica. A segunda é a dimensão da dignidade humana dentro das atuais pré-ocupações do Estado. A terceira é a crise do indivíduo. Por fim, afirma-se que a vida continua sendo um mistério para o ser humano. E este mistério carrega, em seu ventre, grande parcela do sagrado. A atual ideologia que propaga o aborto, como forma terapêutica do homem resolver seus problemas, não passa de pura alienação que nega a sacralidade da vida e, em seu lugar, deixa apenas um homem descarnado de sua própria dignidade. Die jüngste höchstrichterliche Rechtsprechung zur Selbstbestimmung der Patienten und zur Normierung medizinischer Handlungen am Lebensende hat eine intensive Debatte ausgelöst. Das Urteil und die akademisch vorgetragene Kritik werden einer grundlegenden medizinethischen Analyse unterworfen. Sie betrifft die objektive Eingrenzung der Zulässigkeit einer Behandlungsbegrenzung und die Subsumtion des Wachkomas als irreversibel tödliches Grundleiden, das ärztliche Ermessen bei der Indikationsstellung, die normative Einordnung einer Ernährungstherapie am Lebensende und die Verbindlichkeit von Patientenverfügungen. Die medizinethische Kritik offenbart eine unzureichende Wahrnehmung medizinischer und medizinethischer professioneller Dokumente (...) und den Rückgriff auf medizinethisch veraltete Konzeptionen der Sterbehilfe durch das Gericht. Die Folge ist eine fehlerhafte Subsumtion der Wachkomapatienten in die Kategorie irreversibel tödlicher Erkrankungen und eine inhaltliche Schwächung der Verbindlichkeit von Patientenverfügungen. Beides bedarf dringend der Korrektur. (shrink)

In der Medizinethik sind der Respekt vor der Patientenselbstbestimmung, das Nichtschadensgebot, das Handeln zum Wohl des Kranken und das Gerechtigkeitsgebot praxisrelevante Prinzipien. Anhand des Beispiels der Frühintervention und Akutbehandlung schizophrener Störungen wird aufgezeigt, dass es in der psychiatrischen Praxis zu einer Kollision dieser Prinzipien kommen kann. Der frühe Krankheitsbeginn und der häufig chronische Verlauf schizophrener Störungen führen zu großem Leid der Betroffenen und ihrer Angehörigen sowie zur ökonomischen Belastung der Solidargemeinschaft. Die negativen Folgen einer verzögerten Intervention stehen den Risiken der (...) Stigmatisierung sowie den möglichen Nebenwirkungen durch die psychotherapeutische oder psychopharmakologische Behandlung gegenüber. Es wird für eine an der konkreten Situation orientierte, lebensnahe und dynamische Ethik plädiert, die vom konkreten Fall aus diskutiert und verschiedene Perspektiven berücksichtigt – mit dem Ziel von einer Arztethik und Patientenethik zu einer Verantwortungspartnerschaft zu gelangen. Befürworter des Verfahrens weisen die Kritik daher als dunkel zurück oder deuten sie so, dass sie das Verfahren zulässt. Dieser Artikel erläutert den Kern (...) der Zweckformel (im Zusammenhang mit anderen Formulierungen des kategorischen Imperativs). Dieser Deutung zufolge ist die Zeugung von Retterkindern in der Tat eine Form der Instrumentalisierung, die ich präemptive Instrumentalisierung nenne.
